Personal data on the Website are processed by the Controller in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter referred to as "GDPR" or "GDPR Regulation". Taking into account the nature, scope, context, and purposes of processing, as well as the risk of varying likelihood and severity of violations of the rights and freedoms of natural persons, the Controller implements appropriate technical and organizational measures to ensure that processing is carried out in accordance with this Regulation and to be able to demonstrate this. These measures are reviewed and updated as necessary. The Controller implements technical measures to prevent unauthorized access and modification of personal data transmitted electronically.

Right of access, rectification, restriction, erasure, or portability – the data subject has the right to request from the Controller access to their personal data, rectification, erasure ("right to be forgotten"), or restriction of processing, and has the right to object to processing, as well as the right to transfer their data. Detailed conditions for exercising the above-mentioned rights are set out in Articles 15-21 of the GDPR.

The right to withdraw consent at any time – a person whose data is processed by the Controller on the basis of expressed consent (pursuant to Article 6 paragraph 1 letter a) or Article 9 paragraph 2 letter a) of the GDPR Regulation) has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

The right to lodge a complaint with a supervisory authority – an individual whose data is processed by the Controller has the right to lodge a complaint with a supervisory authority in the manner and procedure specified in the provisions of the GDPR and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Personal Data Protection Office.

Right to object – the data subject has the right to object at any time –
for reasons relating to their particular situation – in relation to the processing of personal data concerning them based on Article 6(1)(e) (public interest or tasks) or (f) (legitimate interest of the controller), including profiling based on these provisions. In such a case, the controller is no longer allowed to process such personal data unless they demonstrate compelling legitimate grounds for processing that override the interests, rights and freedoms of the data subject, or grounds for the establishment, exercise or defence of legal claims.

Right to object to direct marketing – if personal data are processed for direct marketing purposes, the data subject has the right to object at any time to the processing of their personal data for such marketing purposes, including profiling, to the extent that the processing is related to such direct marketing.

In order to exercise the rights referred to in this point of the privacy policy, you can contact the Administrator by sending an appropriate message in writing or by e-mail to the Administrator's address indicated at the beginning of the privacy policy.

The Controller is entitled to process personal data in cases where – and to the extent that – at least one of the following conditions is met: (1) the data subject has consented to the processing of his or her personal data for one or more specific purposes; (2) processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract; (3) processing is necessary for compliance with a legal obligation to which the Controller is subject; or (4) processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

The processing of personal data by the Administrator always requires the existence of at least one of the grounds indicated above. The specific grounds for processing the personal data of Website Users by the Administrator are indicated in the next section of the privacy policy – in relation to the specific purpose of personal data processing by the Administrator.

Dane są przechowywane przez okres istnienia prawnie uzasadnionego interesu realizowanego przez Administratora, nie dłużej jednak niż przez okres przedawnienia roszczeń Administratora w stosunku do osoby, której dane dotyczą, z tytułu prowadzonej przez Administratora działalności gospodarczej. Okres przedawnienia określają przepisy prawa, w szczególności Kodeksu Cywilnego (podstawowy termin przedawnienia dla roszczeń związanych z prowadzeniem działalności gospodarczej wynosi trzy lata, a dla Umowy Sprzedaży dwa lata).

Administrator nie może przetwarzać danych w celu marketingu bezpośredniego w przypadku wyrażenia skutecznego sprzeciwu w tym zakresie przez osobę, której dane dotyczą.

Dodatkowo w przypadku, gdy podstawą przetwarzania jest wyrażona zgoda, dane przechowywane są do momentu wycofania zgody przez osobę, której dane dotyczą na dalsze przetwarzanie jej danych w określonym w tej zgodzie celu, lecz bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem.

For the Website to function properly, the Controller must utilize the services of external entities (such as software providers). The Controller only utilizes the services of processors who provide sufficient guarantees to implement appropriate technical and organizational measures to ensure that processing meets the requirements of the GDPR and protects the rights of data subjects.

The Controller does not transfer data in every case and not to all recipients or categories of recipients indicated in the privacy policy – the Controller transfers data only when it is necessary to achieve a given purpose of personal data processing and only to the extent necessary to achieve it.

Personal data may be transferred by the Controller to a third country, and the Controller ensures that in such a case, it will be transferred to a country that ensures an adequate level of protection – consistent with the GDPR Regulation. In the case of other countries, the transfer will be based on standard data protection clauses. The Controller ensures that data subjects have the ability to obtain a copy of their data. The Controller only transfers collected personal data when and to the extent necessary to achieve the given data processing purpose, consistent with this privacy policy.

The personal data of Website Service Users may be transferred to the following recipients or categories of recipients:

  • service providers supplying the Controller with technical, IT and organisational solutions enabling the Controller to conduct business activities, including the Website and electronic services provided via it (in particular suppliers of computer software for running the Website, e-mail and hosting providers, and suppliers of software for managing the company and providing technical support to the Controller) – the Controller makes the collected personal data of the Website user available to a selected supplier acting on its behalf only in the case and to the extent necessary to achieve a given purpose of data processing in accordance with this privacy policy.

The GDPR requires the Controller to provide information about automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the GDPR, and – at least in these cases – meaningful information about the principles underlying such decision-making, as well as the significance and anticipated consequences of such processing for the data subject. With this in mind, the Controller provides information about possible profiling in this section of the privacy policy.

Profiling on the Website involves the automated analysis or prediction of a person's behavior on the Website, for example, by viewing a specific Product page on the Website. The condition for such profiling is that the Administrator possesses the person's personal data so that it can then send them, for example, a discount code.

The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or significantly affects him or her in a similar manner.
